Comment by Planning & Zoning Board member prompts ethics caution from City Attorney

During a quasi-judicial hearing of the Vero Beach Planning and Zoning Board Feb. 6, zoning board member, Mark Mucher, who is also a founding board member of the new Vero Beach Chamber of Commerce, advised a zoning variance applicant that he hoped he would, “save a couple of hundred bucks to join the new Vero Beach Chamber of Commerce.”

Clearly caught off guard, the applicant responded, “Ok, well, we’ll bring that up at our board meeting.”

At least to some, Mucher’s use of his position as a member of the Planning and Zoning Board to promote an organization with which he is affiliated seemed imprudent, if not improper.

Mucher’s comments promoted a memorandum from City Attorney Wayne Coment to all members of the City’s commissions and advisory boards.  Reminding the City’s volunteer board members of the Code of Ethics for Public Officers and Employees, which was adopted by the Florida Legislature, Coment wrote, “…commission and board members should still be ever mindful of the appearance of impropriety as may be perceived by others in this age of televised meetings and public scrutiny.”

The Florida code of ethics states that public officers, “shall not corruptly use or attempt to use his or her official position…or perform his or her official duty, to secure a special privilege, benefit, or exemption for himself, herself, or others.”

  1. Someone told me to lower my expectations from “these people”, but I’d prefer to raise the bar. Stop putting up with this kind of foolishness. Mr. Heady was removed from a volunteer position….and for what? This person promotes a rogue organization, and…….?
