Fitz appeals judgment in short-term rental case

Short-term rental operator, Charles Fitz, is appealing Circuit Court Judge Paul Kanarek rulings in a case involving himself and the City of Vero Beach. Fitz’s lawyers filed an appeal on his behalf May 13.

On May 3, Judge Kanarek issued a final ruling in favor of the City. In his written opinion, Judge Kanarek reasoned that City Code clearly prohibits the operation of transient rentals in areas zoned residential.

After a high-profile case involving former Vero Beach City Councilwoman Tracy Carroll and her husband, John, City officials have taken a firm stand enforcing a long-standing prohibition against transient rentals.

In contrast, the Indian River County Commission, led by Bob Solari, surrendered its right to prohibit so-called transient boarding houses. Some county residents are up in arms over the proliferation of short-term rentals.

  1. Finding a neighborhood to call home is important to most of us. Having that neighborhood opened to overnight or weekly ‘motels’ is not acceptable. Mr. Fitz and Mr. Solari, how about having some of these short-term rentals right next to YOUR residences?
